A legal battle has erupted over the funeral arrangements of Highlife legend Charles Kwadwo Fosu, popularly known as Daddy Lumba, as his legally wedded wife, Akosua Serwaah Fosuh, has filed a suit at the Kumasi High Court to stop his family and an alleged partner from proceeding with burial plans.
In a motion for interlocutory injunction, filed on October 1, 2025, Mrs. Fosuh, through her lawyers Dominion Chambers, is seeking an order restraining the defendants Abusua-Panin Kofi Owusu, Priscilla Ofori (also known as Odo Broni), and Transitions Funeral Home from collecting the body from the morgue or performing any burial or final funeral rites.
The plaintiff claims she is the only surviving spouse of the late musician, having married him on December 23, 2004 in Germany under a monogamous marriage, which, she argues, legally bars any other person from presenting themselves as a spouse.
“The Plaintiff/Applicant is the only surviving spouse of the late Charles Kwadwo Fosu a.k.a. Daddy Lumba,” the court document states, adding that any attempt by the defendants to proceed with funeral arrangements “would deprive her of the right to perform widowhood rites a once-in-a-lifetime cultural and legal entitlement.”
According to the affidavit, the first and second defendants allegedly registered their names as those who deposited the musician’s body at the morgue, thereby controlling access to the remains and excluding the plaintiff. She further accuses the second defendant of fraudulently presenting herself as the surviving spouse.
Mrs. Fosuh argues that if the burial goes ahead without her involvement, she would suffer irreparable harm, including the loss of her legal, customary, and conjugal rights, which cannot be compensated by damages.
She is therefore asking the court to restrain the defendants until the substantive case is determined.
The court is expected to hear the motion in the coming days.
